Voipex Pty Limited collects information directly from its Members. This is done by way of their written application form submissions or by telephone conversations held with them. Voipex Pty Limited does not collect information about Members from any third party. The information collected is necessary for the legitimate functions and activities of Voipex Pty Limited.

 

Collection

The primary purpose for the collection of personal information from Members by Voipex Pty Limited is to provide them with Internet Access and associated services. In order to do this Voipex Pty Limited must be able to identify the Member and ensure that they are over the age of eighteen years where consent of a parent or guardian has not been given. Voipex Pty Limited must be able to communicate with the Member by email, mail and telephone.

With respect to Business Accounts, Voipex Pty Limited gives a business the opportunity to supply their Australian Business Number. This is optional. The sole purpose for collection of an ABN is to include it on the Tax Invoice of the Business Account holder. This information is not used for any other purpose.

Voipex Pty Limited will only use personal information for a purpose other than the primary purpose of collection if:

 

  • The secondary purpose is related to the primary purpose of collection; and
  • The subject of the information would reasonably expect Voipex Pty Limited to use the information for the secondary purpose; and
  • The use is made in the performance of Voipex Pty Limited’s duties; or
  • The Member has consented to the use; or
  • Voipex Pty Limited reasonably believes that the use is necessary to lessen or prevent a serious and imminent threat to an individual’s life or health; or
  • Voipex Pty Limited has reason to suspect that unlawful activity has been, is being or may be engaged in, and uses the personal information as a necessary part of its investigation of the matter or in reporting its concerns to the relevant persons or authorities; or
  • The use is required or specifically authorised by law; or
  • The use is reasonably necessary for the enforcement of the criminal law, a law imposing a pecuniary penalty, or for the protection of the public revenue.

 

Disclosure

Voipex Pty Limited will disclose personal information for a purpose other than the primary purpose of collection if:

 

  • The secondary purpose is related to the primary purpose of collection; and
  • The subjection of the information would reasonably expect Voipex Pty Limited to disclose the information for the secondary purpose; and
  • The disclosure is made in the performance of Voipex Pty Limited’s duties; or
  • The Member has consented to the disclosure; or
  • Voipex Pty Limited reasonably believes that the use is necessary to lessen or prevent a serious and imminent threat to an individual’s life or health; or
  • Voipex Pty Limited has reason to suspect that unlawful activity has been, is being or may be engaged in, and uses the personal information as a necessary part of its investigation of the matter or in reporting its concerns to the relevant persons or authorities; or
  • The use is required or specifically authorised by law; or
  • The use is reasonably necessary for the enforcement of the criminal law, a law imposing a pecuniary penalty, or for the protection of the public revenue or has been certified as reasonably necessary by an Authorised Officer of an enforcement Agency; or
  • The disclosure is made to an officer or employee of ASIO authorised to receive it and in connection with the performance of ASIO’s functions.

 

Data Quality, Security, Openness, Access and Correction

Voipex Pty Limited Members may access their personal information at Voipex Pty Limited Member Services. Members will require their login name and password to access this information. Members are encouraged to check the information on a regular basis to ensure it is correct and up to date. Where information held is no longer correct, they may either:

 

  • Make the amendments themselves on the website.
  • Email the corrections to accounts@voipex.com.au
  • Telephone us to make the corrections

 

Transborder Data Flows

Voipex Pty Limited will not transfer personal information outside Australia unless: Voipex Pty Limited believes that the recipient of the information is subject to a statute, binding scheme or contract which effectively upholds principles for fair information handling that are substantially similar to the Protection of Personal Information of Customers of Telecommunications Providers Code registered by the Australian Communications Authority; or

 

  • Voipex Pty Limited believes that the recipient of the information is subject to a statute, binding scheme or contract which effectively upholds principles for fair information handling that are substantially similar to the Protection of Personal Information of Customers of Telecommunications Providers Code registered by the Australian Communications Authority; or
  • The Member consents to the transfer; or
  • The transfer is necessary for the performance of a contract between the Member concerned and Voipex Pty Limited, or for the implementation of pre-contractual measures taken in response to the Members request; or
  • The transfer is necessary for the conclusion of performance of a contract concluded in the interest of the individual concerned between Voipex Pty Limited and a third party; or
  • The transfer is for the benefit of the Member concerned; and
  • It is not practicable to obtain the consent of the subject of the information to that transfer; and
  • If it were practicable to obtain such consent, the subject of the information would give it; or
  • Voipex Pty Limited has taken reasonable steps to ensure that the information which it has transferred will not be collected, held, used or disclosed by the recipient of the information inconsistently with the Industry Code for the Protection of Personal Information of Customers of Telecommunications Providers.

 

Sensitive Information

Voipex Pty Limited does not collect personal information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, or details of health, disability or sexual activity or orientation unless:

 

  • The subject of the information has consented; or
  • The collection is required or specifically authorised by law; or
  • The collection is necessary to prevent or lessen a serious and imminent threat to the life or health of any individual, where the subject of the information is physically or legally incapable of giving consent; or
  • The collection is necessary for the establishment, exercise or defence of a legal claim. Voipex Pty Limited complies with the Protection of Personal Information of Customers of Telecommunications Providers Code registered by the Australian Communications Authority.
